Abstract
Článek se zabývá analýzou soudních rozhodnutí týkajících se náhrady nemajetkových nároků pozůstalých při usmrcení osoby blízké v důsledku dopravní nehody. V článku jsou rozebrány finální rozhodnutí z databáze soudních rozhodnutí, které byly evidovány na https://www.datanu.cz. Srovnány jsou rozhodovací praxe mezi rozhodnutími, která spadala do období účinnosti zákona č. 40/1964 Sb. (starého občanského zákoníku) s těmi, která již spadají do období účinnosti zákona č. 89/2012 Sb. občanského zákoníku. V databázi soudních rozhodnutí jsou uvedeny kromě požadované a přiznané částky i další údaje o případu (věk poškozených, počet pozůstalých, jejich věk a příbuzenský vztah k oběti nehody, popis případu atd.). Popsány jsou taktéž vybrané proměnné, které byly analyzovány ve vztahu k výši přiznané částky. V závěru jsou pak uvedeny finanční částky nemajetkové náhrady stanovené soudy.
The paper deals with the analysis of court decisions concerning compensation for non-pecuniary claims of survivors in the event of death of a close person as a result of a traffic accident. The paper analyses the final decisions from the database of court decisions that have been registered at https://www.datanu.cz. Comparisons are made between the decisions that fell within the period of effectiveness of Act No. 40/1964 Coll. (the old Civil Code) and those that already fall within the period of effectiveness of Act No. 89/2012 Coll. of the Civil Code. In addition to the amount claimed and awarded, the database of court decisions also includes other information about the case (age of the victims, number of survivors, their age and relationship to the accident victim, description of the case, etc.). The selected variables analysed in relation to the amount awarded are also described. Finally, the financial amounts of non-pecuniary compensation determined by the courts are presented.
