dc.description.abstractCílem tohoto příspěvku, jenž navazuje na příspěvek z minulého čísla, je nastínění platné právní úpravy, vztahující se k bezdůvodnému obohacení, dle nyní platného občanského zákoníku, zákona č. 89/2012 Sb., její komparace se zněním předchozím a důsledky v rámci této problematiky. Snahou je poukázat na inkorporaci nových ustanovení, která reflektují na rozhodovací praxi soudů. Závěrem tohoto příspěvku by mělo být poukázáno na snahu zákonodárců rozšířit pravomoci a posílit jistotu ochuzených, s důrazem na dobré mravy, slušnost a spravedlnost. V dalším příspěvku budou uvedeny praktické ukázky ze stavebnictví.cs
dc.description.abstractThe aim of this article is show the current legislation relating baseless enrichment, according to the current Civil Code, Law No. 89/2012 Coll., a comparison of its consequences the context of this issue. The aim is to highlight the incorporation of new provisions that reflect the decision-making practice of the courts. Finally, this post should be made to the efforts legislators to extend the powers and strengthen the security of impoverished, with a focus on good manners, decency and justice. In the next article will be shown practice exercise from the building area.en
