dc.description.abstractČlánek se zabývá analýzou problému, který vznikl v podmínkách České republiky po roce 1989, kdy se ČR začala začleňovat do struktur Evropské unie a širšího evropského a světového prostoru. V souvislosti se stále širším využíváním doporučení Mezinárodních oceňovacích standardů se i v ČR klade důraz na rozlišování pojmů cena a hodnota při oceňování. Oproti tomu právní předpisy ČR stále pracují s pojmy, které takové rozlišení nepoužívají. Pro znalce tak vzniká nestandardní situace. Pojmová neujasněnost může vést k nesprávné interpretaci výsledků oceňování. Nevhodné využití výsledků může ovlivnit správnost rozhodnutí orgánů veřejné moci, příp. právní jednání fyzických a právnických osob. Článek se zabývá srovnávací analýzou pojmů cena a hodnota v právních předpisech ČR a v mezinárodních oceňovacích standardech. Vysvětluje významové odlišnosti, které jsou důležité pro správné chápání výsledků oceňování, a navrhuje řešení pojmového ujasnění v dané oblasti.cs
dc.description.abstractArticle deals with the analysis of problem, which has been existing since 1989 under conditions of the Czech Republic. After ages of communism, the Czech Republic started to integrate to European Union and wider European and International structures. In connection with usage of recommendation resulted from International Valuation Standards the emphasis is put on distinguishing of terms price and value at evaluation. On the contrary the legal regulations keep working with terms, which do not use such distinguishing. There is nonstandard situation for experts. Lack of terms clarity can lead to wrong interpretation of evaluation results. Appropriate usage results could influence the correctness of public authorities’ decisions, eventually the correctness of legal acts of natural and legal persons. Article deals with comparison analysis of terms of price and value, shows differences in their understanding according to International Valuation Standards and Czech legal system. Article explains differences in meanings, which are important for proper understanding of evaluation and suggests attitude for clarification of terms in the branch of property evaluation.en
