Interakce práva a ekonomie u projektové dokumentace

Abstract

Bakalářská práce se zaměřuje na analýzu interakce mezi právními a ekonomickými aspekty projektové dokumentace v oblasti stavebnictví. Cílem práce je prozkoumat, jak právní předpisy, zejména v oblasti územního řízení a stavebního povolení, ovlivňují ekonomické aspekty stavebních projektů, a to nejen z pohledu investorů, ale i projektových kanceláří a dalších zúčastněných stran. V praktické části práce jeanalyzováno problematické získávání územních rozhodnutí, jeho vliv na zpoždění projektů a s tím související finanční dopady, jako jsou zvýšené náklady, ušlý zisk apotenciální ztráty pro všechny zúčastněné. Dále se práce zaměřuje namožné změny v procesním rámci s příchodem nového stavebního zákona, který přináší úpravy v oblasti územního řízení a celkově mění dynamiku povolovacích procesů. Vposlední části jsou uvedena doporučení, jak minimalizovat zpoždění vpovolovacím procesu a zlepšit ekonomickou efektivitu projektů. Výsledky práce ukazují, že efektivní komunikace mezi investory, projektanty a úřady, stejnějakosprávné nastavení právních a ekonomických parametrů, jsou klíčové proúspěšnou realizaci stavebních projektů.The bachelor thesis focuses on the analysis of the interaction between the legal and economic aspects of project documentation in the field of construction. Theaim ofthe thesis is to investigate how legal regulations, especially in the field ofzoning and building permits, affect the economic aspects of construction projects, not only from the perspective of investors, but also from the perspective of design firms andother stakeholders. The practical part of the thesis analyses theproblematic process of obtaining planning permission, its impact on project delays and the associated financial implications such as increased costs, lost profits andpotential losses for all involved. Furthermore, the thesis focuses on the possible changes inthe procedural framework with the advent of the new Construction Act, which brings changes in the sphere of zoning procedures and changes the overall dynamics ofthe permitting process. In the last section, recommendations are given to minimize delays in the permitting process and improve the economic efficiency of projects. The results of the paper show that effective communication between investors, designers and authorities, as well as the correct setting of legal andeconomic parameters, are crucial for the successful implementation ofconstruction projects.
