Technické podmínky zadávací dokumentace mezi Českem a vybranými státy EU

Abstract

Tato bakalářská práce se zabývá analýzou technických podmínek v zadávacích dokumentacích veřejných zakázek na stavební práce ve vybraných členských státech Evropské unie – České republice, Rakousku a Německu. Cílem práce je porovnat přístupy těchto států k vymezování technických podmínek a identifikovat rozdíly v jejich pojetí. Pomocí obsahové analýzy konkrétních zadávacích dokumentací a příslušné legislativy byly zkoumány formální i obsahové aspekty těchto podmínek, zejména projektová dokumentace a výkaz výměr. Výsledky práce přispívají k lepšímu porozumění procesu zadávání veřejných zakázek a k identifikaci rozdílů ve zpracování technických podmínek v ČR, Rakousku a Německu, které mohou ovlivnit možnost přeshraniční účasti dodavatelů.This bachelor’s thesis focuses on the analysis of technical conditions in the tender documentation for public construction contracts in selected member states of the European Union – the Czech Republic, Austria, and Germany. The aim of the thesis is to compare the approaches of these countries to the formulation of technical conditions and to identify differences in their interpretation. Through content analysis of actual tender documentation and the relevant national and EU legislation, both formal and substantive aspects of the technical specifications were examined, with particular attention to project documentation and bills of quantities. The findings contribute to a better understanding of the public procurement process and highlight key differences in how technical specifications are structured in the Czech Republic, Austria, and Germany. These variations may affect the potential for cross-border participation of suppliers within the EU single market.
