Firma, podnik nebo obchodní závod? Některé termíny ekonomických disciplín v konfrontaci s jejich legální definicí

Abstract

Cílem příspěvku je prostřednictvím metod analýzy a komparace identifikovat rozdíly, resp. shodu mezi významem některých odborných ekonomických termínů používaných v českém jazyce a legálními definicemi těchto pojmů v kontextu nedávné rekodifikace soukromého práva, a to zkoumáním definic, kontextového používání a výkladu ekonomických termínů v ekonomických slovnících a ekonomických textech renomovaných autorů a legálních definic stejných termínů uváděných v právních předpisech. Na základě komparace budou nastíněny návrhy, jak uvedené termíny správně používat v odborných ekonomických textech (nejen s právním přesahem), s cílem vyhnout se negativním dopadům polysémie.This paper aims to identify differences or correspondence between the meaning of some specialized economic terms used in Czech language and legal definitions of these terms in the context of the recent Czech private law recodification, by methods of analysis and comparison, examining definitions, contextual usage and interpretation of economic terms in economic dictionaries and economic texts by renowned authors and legal definitions of these terms in legislation regulations. On the basis of comparison suggestions will be outlined, as how to properly use these terms in professional economic texts (not only with legal overlap), in order to avoid negative impacts of polysemy.
