Abstract
Tento příspěvek se zabývá problematikou staveb na cizích pozemcích v souvislosti se změnou právní úpravy od 1. 1. 2014. Pojednává o nové právní zásadě, že stavba je součástí pozemku, a analyzuje problémy s tím spojené. Nabízí dále právní řešení situace, kdy chce stavebník postavit, přičemž v některých případech se i tato stavba stane součástí pozemku, na kterém byla postavena (a patří tak vlastníkovi pozemku) a v jiných nikoliv.
This paper deals with the issue of buildings on foreign land under the new legal regulation from 1 January 2014. It deals with the new legal principle superficies solo cedit (the building is a part of the land) and analyzes the problems associated with it. It also offers a legal solutions of situations where the builder wants to build on the foreign land – in some cases this building will be part of the land on which it was built (and belongs to the owner of the land) and in others not.
