Optimální postup vypořádání podílového spoluvlastnictví

Abstract

Diplomová práce se zabývá optimálním postupem vypořádání podílového spoluvlastnictví nemovitostí, se zaměřením na reálné dělení nemovitosti jako preferovaný způsob vypořádání. Cílem práce je posoudit vliv odlišností ve vlastnictví konkrétní nemovitosti na možnosti jejího reálného rozdělení a stanovit cenu obvyklou jednotlivých částí v podílovém spoluvlastnictví. Teoretická část se věnuje vymezení základních pojmů z oblasti oceňování nemovitostí, právnímu rámci spoluvlastnictví a metodám vypořádání. V praktické části je na modelové nemovitosti analyzována možnost reálného dělení z hlediska právního, technického i ekonomického. Výsledkem práce je návrh optimálního postupu reálného dělení, který zohledňuje specifika konkrétní nemovitosti a poskytuje efektivní řešení vypořádání spoluvlastnických vztahů.The diploma thesis focuses on the optimal procedure for settling co-ownership of real estate, with an emphasis on the real division of the property as the preferred method of settlement. The aim of the thesis is to assess the impact of ownership differences in a specific property on the possibilities of its real division and to determine the market value of individual parts under co- ownership. The theoretical part is devoted to defining basic concepts in the field of property valuation, the legal framework of co-ownership, and methods of settlement. The practical part analyzes a model property to evaluate the feasibility of real division from legal, technical, and economic perspectives. The outcome of the thesis is a proposal for an optimal procedure of real division that takes into account the specifics of the property and offers an effective solution for settling co-ownership relations.
